Clark Waldon is a licensed patent attorney who practices complex intellectual property and commercial litigation, on behalf of companies and individuals in a wide range of industries and disputes, including utility and design patent, trademark, trade dress, copyright, unfair competition, and trade secret.
Prior to joining Holland Law, Clark worked as an intellectual property litigation associate at Ropers, Majeski, Kohn & Bentley PC and Tingley Law Group PC. While pursuing his law degree, Clark tailored his curriculum to align with his eventual legal practice by taking courses in intellectual property, biotechnology, patent litigation, privacy, international intellectual property, and assisted reproduction, genetic engineering, and cloning. Clark also served on the editorial board of the High Technology Law Journal. During law school, Clark interned at a boutique patent prosecution law firm, a digital product engineering services company, and a television software company working on patent portfolio management, prosecution, licensing, and litigation.
In addition to his legal and scientific background, Clark plays multiple instruments and writes and records original music. Clark’s technical and creative abilities provide him a first-hand appreciation for, and understanding of, his clients’ intellectual property and litigation needs, and give him an edge in finding and applying inventive strategies and solutions.
- Represented an e-commerce startup in a dispute regarding artificial intelligence technology. Result: favorable global settlement of multiple lawsuits and an arbitration.
- Defended an e-bike company in a patent and trade dress infringement lawsuit. Result: early settlement satisfying all of client’s business objectives.
- Defended a wholesale products company against claims of patent, trademark, trade dress, and copyright infringement. Result: favorable global settlement during claim construction.
- Defended a trademark and trade dress infringement case brought by a large energy drink company. Result: advantageous settlement retaining rights desired by client.
- Defended a contractor’s licensing school against claims of copyright infringement against a competitor. Result: full dismissal of all claims after successfully opposing a motion for preliminary injunction.
- Entered various patent licensing and settlement agreements before and during litigation with television providers and social media companies on behalf of a television software company.
- Represented a memory storage company asserting claims of misappropriation of trade secrets, breach of contract, breach of fiduciary duties, and interference with contractual relationships against a former employee. Result: remunerative settlement recouping lost profits.
- Defended a statue maker against claims of copyright and trademark infringement regarding a comic book character. Result: favorable settlement after successfully opposing a motion for summary judgment.
- Represented a volleyball event organization in a trademark, copyright, and partnership dispute. Result: settlement retaining brand rights sought at no cost to client.
- Defended an oil valve manufacturer in a patent dispute against a competitor. Result: favorable settlement agreement permitting defendant to continue producing and selling its products.
- Represented a graphics company against claims of copyright infringement and breach of Creative Commons licenses regarding use of photographs. Result: full defense settlement with zero dollars paid by client.
