Ethan Jacobs is an experienced litigator and problem solver. Ethan has successfully represented both plaintiffs and defendants in a wide variety of business disputes and his experience covers the entire spectrum of intellectual property law, from patents and copyrights to trademarks and trade secrets. During his legal career, Ethan has served clients across many diverse industries including software, entertainment, private equity, real estate, and solar energy.

Immediately before joining Holland Law as a partner, Ethan worked for Keller, Sloan, Roman & Holland LLP in San Francisco.  Prior to that, he practiced for several years at the New York offices of Covington & Burling and Vinson & Elkins and served as a law clerk to the Honorable Naomi Reice Buchwald in the United States District Court for the Southern District of New York.

Notable Engagements

  • Has successfully represented Sunrun Inc., a nationwide provider of residential solar energy facilities, in a variety of high-value commercial disputes.
  • Represented technology entrepreneur in disputes and litigation arising from the dissolution of a bitcoin exchange and the launch of a new virtual currency startup.
  • First chair of jury trial representation of the author of Point Break LIVE!, a parody of the 1991 action film Point Break, in her lawsuit against a producer for breach of contract and copyright infringement. Result: unanimous verdict and damages award for client—one of only a few trials nationwide in which a jury has decided “fair use” under the Copyright Act. See Keeling v. New Rock Theater Productions, LLC, S.D.N.Y. Case No. 10 Civ. 9345.
  • Successfully represented major household goods manufacturers against patent infringement lawsuit accusing unit-dose laundry products. Result: achieved extremely favorable settlement shortly after victories on claim construction and summary judgment rulings.
  • Represented accrediting commission in City Attorney lawsuit arising from commission’s decision to terminate community college’s accreditation. Result: the October 2014 court trial culminated in a defeat of all of City Attorney’s claims that the commission was motivated by political and personal bias against the college.
  • Represented a major record company in purported class actions challenging the payment of artist royalties on downloads of digital music and ringtones. Result: case resolved by favorable settlement.
  • Successful trial defense of real estate marketing company and its principals against claims for breach of contract and conversion arising from a loan by a hedge fund, and secured dismissal of related claims before trial. Result: judgment for defendants on all claims after bench trial.
  • Successful Delaware Chancery Court trial representation of co-founder of private equity firm against allegations of breach of contract and fiduciary duties. Result: case settled on first day of trial after accelerated discovery.
